The "water damage" and/or "flood "exclusions seem to contradict other policy
provisions in these polices which provide full coverage for wind damage
caused by Hurricane Katrina. There are even hurricane deductions in the
policies. I think the issue in a contract is there a meeting of the minds.
Did the folks having homeowner's insurance reasonably believe that they were
covered by a storm surge. I think that storm surge is more than just wind
driven water. It is a phenomenon that is a combination of wind, low pressure
etc. All one has to do is look at the definition. I did notice that State
Farm included the word Tsunami in its exclusions this year in my policy. If
wind driven rain covered everything, why would Tsunami have been added.
Because I think it is a phenomenon like storm surge. If the policies wanted
to be clear, why couldn't they have simply stated "storm surge" in the
policy exclusions. L
