Sidewalks /vs Removed sidewalks In buy out area:

Unfortunately when the ordinance was structured a very important statement
was ommitted.
The statement as to where there are houses there will be sidewalks did not
mean that only the houses that remained would have sidewalks.

The ordinance language should have stated: "where there are COMPLETE BLOCKS
that have been purchased and used as green space in the buffer zone, those
sidewalks needed to be removed for the maintenance of that property.}} ....

However, when the council drafted the ordinance it was not made clean that
if a block had even one house left on it that ALL sidewalks shoud remain.

Either the language of the oridnance was not made clear intentionally or
just another blunder and rush job of our previous governing body.

Murphy's damage/claim assessors (Pat Aucoin) still contends that if a
sidewalk was damaged during the demo of a piece of property that they caused
that it is the parish responsibility to fix it. B...S....

However, here we are. Residents that are not selling, have no intention of
selling, but are attempting to get on with our lives without adjacent
property sidewalks with some of our own sidewalks damaged.

At this time I have no one young enough that would want to ride a bike down
the sidewalk. However it won't be long until I hopefully have a great
grandchild and I would certainly want to be able to walk along side of him
or her while they learned to ride a bike.

When St Bernard Parish Attorney appeared before the council on March 6,
2007, he speaks of the agreement between Murphy Oil and SBPG to remove
sidewalks in exchange for a hold harmless agreement with Murphy Oil. When
asked by the councilwoman if what they had decided with regards to the
street lights, he states that the "street lights will remain because people
still live there so it will not be a total greenspace." Those quotes are on
the dvd to the March 6, 2007 meeting if you would like to view it. . The
