I absolutely agree with you. Liberals like using this purely as a "scare tactic" basing the strength of their position on "you know the U.S. Supreme Court ruled it's constitutional." What they don't realize is the high court's ruling applied only to the circumstances and situation presented to it for that particular case.

Bottom line here...does anyone (especially the liberal Democrats) really believe the current conservative majority on the Court lead by Scalia, Roberts and Thomas is not going to overturn any "fairness" doctrine legislation passed by "this" current Congress? Of course not. Even they know the Court won't, even if their decision is purely a political one. And for that matter, the Dem-wit Party knows the GOP will filibuster and such legislation in the Senate, so it won't even get to the Courts to be challenged.

The only way the Supreme Court ever upholds a future fairness doctrine law is if the conservative justices drop off and Barry gets to put fresh liberals on the Court...and that's not happening in the next four years.
