[StBernard] Policyholders prevail against State Farm

GULFPORT - U.S. District Judge L.T. Senter Jr. today upheld a $174,881.80
payment for Katrina wind damage to policyholders who were forced to sue
State Farm after the company refused to pay the amount awarded through
appraisal.

Senter found the appraisal, an alternative to litigation offered in the
State Farm policy, "valid, binding and enforceable." He ordered State Farm
to pay the judgment, plus interest from the time by which State Farm was
supposed to pay in 2008.

Attorney Earl Denham filed the federal lawsuit for policyholders Henry and
June Kuehn only after State Farm refused to pay the appraisal award.


Senter also will consider the policyholders' claims for punitive damages
against State Farm.
