[StBernard] Federal Judge Roger Vinson throws out "all" of Obamacare

Judge Vinson's ruling today throwing out Obamacare (January 31, 2011).



Legal experts are already calling it one of the most learned district court
opinions they've ever read.



On page 42, Judge Vinson strikes at the heart of Obamacare's
unconstitutionality - and the basis on which our nation was formed. You
liberals out there might need to re-read this a few times. If you can't
come to grips with what Judge Vinson says here, then our nation will NEVER
be unified because you will be AGAINST the very principles on which our
constitution is based.



Judge Vinson writes:



"It is difficult to imagine that a nation which began, at least in part, as
the result of opposition to a British mandate giving the East India Company
a monopoly and imposing a nominal tax on all tea sold in America would have
set out to create a government with the power to force people to buy tea in
the first place. If Congress can penalize a passive individual for failing
to engage in commerce, the enumeration of powers in the Constitution would
have been in vain for it would be "difficult to perceive any limitation on
federal power" [Lopez, supra, 514 U.S. at 564], and we would have a
Constitution in name only. Surely this is not what the Founding Fathers
could have intended."



BINGO!! What Judge Vinson is saying here is it was a big goof on the part
of the U.S. Attorney to use the "Commerce Clause" as the basis for the
justification of Obamacare. For it was an act by King George III of
"forcing us into an act of commerce against our will" which started the
fires of revolution against England. So, how can Congress today commit the
same horrible act of King George and say it's now constitutional? Because
it says it is? Utter nonsense.



Yes, we have a medical insurance problem in this country today (let's try
and get away from the term Healthcare), but forcing everyone to do something
against their will and unconstitutional is NOT the way to go about fixing
it.

decision, I'll be glad to pass it on for you. I see him regularly at
Camellia Growers shows, which my wife and I participate - Judge Vinson is
the president of the (national) American Camellia Society and often shows up
at the shows in the south.
