The attachment is a Map showing the Wetlands, Four Apartment Buildings, the
Apartment entrance road and nearby Banks, Condos, Wal-Mart etc. located on
and near the Provident Realty property (Aberdeen Court) near Jean Lafitte
Parkway.

 

The original map was requested and provided to us by the Corps of Engineers
showing the wetlands that existed on this track of land.

 

According to my calculations, two of the Apartment Buildings protrude into
the Wetlands. The C.O.E has issued a Cease and Desist Order but Provident
Realty workers continues to build the Apartment building closest to West
Judge Perez Drive that protrudes into the wetlands. 

 

On Mr. Heffner first visit, he marked the Wetland perimeter then a few days
later the flagging was missing.  I notified Mr. Heffner of this and he told
me that they (pointing to the Provident Realty workers) moved them.  On Mr.
Heffner's second visit to remark the perimeter he did not mark the same
location of the wetland perimeter as his first visit.  The flagging now goes
around the Apartment building closest to West Judge Perez Drive.

 

We have been notified, that the Army Corp of Engineers will "STREAMLINE"
Provident Realty's Wetland Permit application because the property has only
0.3 acres of Wetlands on it. First it had no Wetlands, then it DOES have
Wetlands. Now it only has 0.3 acres of Wetlands. My calculations show a
larger amount of wetlands than 0.3 acres.  Is this an ERROR also?

 

It also appears that additional Wetlands have been missed by our Army Corps
of Engineers at the entrance to this development. We need the C.O.E to do a
detailed grid analysis on this property by boring core samples into the
ground to determine the exact location of the wetlands and the exact amount
of wetlands calculated on this tract of land. That is the only way now that
the Wetland locations and amount of Wetlands can be determined because of
the chemicals used to destroy them. Very soon Provident Realty Advisors will
pour the concrete slabs over our Wetlands and Core Sampling may be
impossible.

 

Please email Mr. Heffner at  Robert.A.Heffner at usace.army.mil  to notify him
of these findings. We need him to come out ASAP and correctly mark ALL the
Wetlands on this Property and order a Cease and Desist on ALL WETLANDS
located on this property.  I have already notified him by email with
attached photos (March 15, 2011) that Provident Realty workers were digging
with shovels and dumping concrete out of five gallons buckets into the
Wetlands already marked off by him.  He has Not Responded to that email. I
will send the complaint Certified Mail, Return Receipt next.
