I reviewed and issued the permit in question and agree that the wording for

block 23 can be arbitrary; however, the drawings accurately show the project

boundaries. Our Surveillance and Enforcement Section has been to the site

many times and verified the 0.3 acres of impact which is shown in the permit

application. The permit issued by the Corps on March 21, 2011 allows him
to

work within this area.



As for the information in block 20, the permittee is required to construct

and maintain siltation controls around the construction site that require

earthwork. To my knowledge, DEQ has been to the site on 3/17 and 3/30. On

the second visit, some of the siltation controls were damaged by the recent

storm event and the controls were put back in place shortly thereafter.



During the time of the permit review, this office was aware that the

information for block 26 was influx due to all the cease and desist orders

that stemmed from the one issued by the Corps; that is why the permit issued

included the following information: "The determination is only applicable to

the permit program administered by the U.S Army Corps of Engineers. It does

not eliminate the need to obtain other applicable federal, state, or local

approvals before beginning work."

appears to be compliant with the permit conditions.

Thank you for responding and forwarding this potential crime to the Project
Manager that issued the wetlands permit. I sure he will be very interested
in re-reviewing his decision for this applicant.



I am also requesting you forward this information to the proper law
enforcement authorities or USACE enforcement division that can file charges
for Federal crimes against this individual for possibly falsifying
information on the Federal wetlands permit application he signed.



I also have photos on April 08, 2011 of Provident workers that removed a
protective storm water filter (appeared to be a cloth type filter over the
end of their storm water drainage pipe) and used a gasoline water pump to
try and unclog the pipe with water pressure from the pump. While attempting
to doing this, the water/sand sediment, possibly cement chemicals, etc.

started flowing back out of the Provident Realty/Aberdeen Court drainage
pipe and into St. Bernard Parish's Bluebird canal. The sheriff's office was
called out.



I believe that is a direct violation to the NWP 39 wetlands permit and I am
again requesting the wetlands permit be pulled and revoked immediately.

Matthew B. Harris, of Provident Realty Advisors/Aberdeen Court, LLC may have
false information on the Parc Place/Aberdeen Court, LLC wetlands permit
application and may be subject to penalties/fines and imprisonment.

Provident Realty/Aberdeen Court, LLC may also be in violation of the
existing wetland permit.



Just below his signature on the Wetlands permit application it states:





"The application must be signed by the person who desires to undertake the
proposed activity (applicant) or it may be signed by a duly authorized agent
if the statement on block 11 has been filled out and signed"



"18 USC Section 1001 provides that. Whoever, in any manner within the
jurisdiction of any department or agency of the United States knowingly and
willfully falsifies, conceals, or covers up, any trick, and scheme, or
disguises a material fact or makes any false, or fraudulent statement or
representations or makes or uses any false writing or documents knowing the
same contain any false or fraudulent statements or entry, SHALL BE FINED NOT
MORE THAN 10,000.00 OR IMPRISONED NOT MORE THAN FIVE YEARS OR BOTH."

Matt Harris Answer: Development is compressed to the South and West of POND
area.



I believe this is FALSE, MISLEADING, DIGUISING A MATERIAL FACT: As you know
the Army Corp of Engineers issued a Cease & Desist Stop work Order stopping
Provident Realty Advisors/Aberdeen Court, LLC, from building one of his
apartment buildings on top of the WETLANDS POND area.



Question Number 20: Reasons for Discharge:



Matt's Answer: No materials to be discharged to waters. TO MITIGATE
FLOODING, clean fill materials to raise the 4.0 acres site an average of 4
feet. This will impact approximately 3/10 acres of WETLANDS.



I have many photos that show sand sediment, and some sort of chemical that
looked like it could be from the cement poured for the pilings, were
discharged onto my property and nearby waters of the Parish and possibly the
State.



Question Number 26: List the other certifications of approvals/Denials
received from other Federal, State and Local agencies for work described in
this application.

I am not in law enforcement, but In my opinion, this may be a crime
punishable by our Federal laws.
