Actually, to convene the Convention of States they only need 34 states,
which the COS organizers believe they have. In shooting for 38 states I
believe Levin is trying to get the number of states to participate in the
Convention that would be needed to ratify any carried amendments that would
have to go to each of those states' legislatures for approval - which is 38
(75% of the states are needed to ratify an amendment).

But, just because the COS would approve a proposed amendment (even with 38
states or more) does NOT necessarily mean they will pass the state
legislatures. At the COS each state will be represented by only a small
delegation (and from each delegation will likely have only a few state
legislators from a given state). While the COS is trying to have
legislative delegates that will be indicative of how their respective states
will likely vote on ratification (which does help), but no means is that a
sure thing that the simple majority of legislators back in their home states
will in fact pass it.

Mark Meckler is one the lead organizers of the COS. He has stated they know
they will have enough states (at 34) to convene, but what they are going for
is to have enough states participates to where they are confident the
amendments that are proposed will pass three quarters of the state
legislatures.
