Lawsuit against the parish regarding the water and sewer rate fee to be
dismissed

In Case No. 119-732, 34th Judicial District Court, the opposing counsel has
agreed to dismiss the case with prejudice.  The lawsuit was initiated by
Peter A. Rupp who sued David Peralta, President of St. Bernard Parish, et
al. for the water and sewer fee that was put on the residents and businesses
of the parish.  

The attorney representing St. Bernard Parish Government has filed for a
motion to dismiss and ask that all costs of the proceedings be taxed against
the plaintiff including the cost of notifying the putative class members of
the dismissal. 
 
The attorney representing Peter Rupp advised the court that Mr. Rupp was
dropping the suit with prejudice on November 26, 2014.  The plaintiff (Mr.
Rupp) must pay the plaintiff’s cost to file the dismissal in the amount of
$160.00.  Since Mr. Rupp has failed to pay the ordered cost the Government’s
Attorney has filed a contradictory motion to dismiss.
