Whether the sidewalks surrounding the campus of Nunez Community College, and
the
grass between the sidewalks and the street, are within the campus's
boundaries for
purposes of the College's smoke-free and tobacco-free policy is a question
of fact that
turns on the extent of the College's property ownership. Assuming that the
College's
boundaries actually are "curb to curb, on all sides of the campus," the
College has the
discretion to develop smoke-free and tobacco-free policies over all of that
area. Such
policies could, for example, provide for smoking or the use of tobacco in
designated
outdoor areas on the College's grounds such as the sidewalks surrounding the
campus
and the grass between the sidewalks and the street. (Traina)
