Jer/Jim/David,

My point isn't to give Murphy a free ride. Yes, they were negligent in
allowing the oil to spill and their attorneys are going to fight to limit
their exposure as much as possible. Since they did also make a claim
against their own insurance company, the insurance companies lawyers are
going to do the same thing and try to limit exposure.

We can all say what we want, but it is nothing more any of us would do in
the same situation.

If you bump into the car in front of you forcing him into the next car, you
will accept the responsibility. However, if there was a car in front of
that third car that started claiming he was hit too, you would have some
reservations about it unless you knew you hit the first car super hard.

Murphy can't get away scott free, but I do believe that they were making an
effort to settle with residents.

Unfortunately, I think Torres with his class action has limited the actions
Murphy can take to settle with residents. It has also forced them even more
into a defensive mode. They are not going to give the ammunition (test
results) to those they are about to battle with.

In a better world, I think it would have been settled a lot easier and
quicker. But with so many people out looking for undeserved handouts, it
just mucks everything up.

Remember the fire they have about two years ago and the number of suits that
were filed as a result of it? The fire never left the confines of the
plant, but how many people started looking for handouts? I would love to
know how many people went to the "tail-gate" party to watch the fire and
then turned around and sued Murphy? With the numerous video tapes and
pictures that were taken, I would hope that everyone of those individuals
was automatically rejected as a claim.

Sort of sounds like a double-edged sword or a husband/wife according to the
old addage: "Can't do with them - Can't do without them!

STILL, we can't ki$$ their a$$es, but like the Alamo: "Remember the . ."

Just because we're shackled by dubious attorney's doesn't let Murphy off
their "responsibility hook". They are at fault and trying to make a tax-base
excuse for those who suffer needlessly and can't return because of
negligence doesn't make it proper.

However, in fairness to Murphy, we DID know we stood in harm's way during an
emergency which could occur in their backyard and stll we chose to live in
the mist of things next to it (even though next in this case means up to 3
miles).

Losing jobs are secondary to losing homes, neighborhoods and communities,
don't you agree?
