[StBernard] St. Bernard panel opposes truck stop

Gaby, here's what happened at the meeting of the Council on Nov 20th
Looks like the Council gave the Truck Stop a conditional use permit. It was
approved by all Council members except Lynn Dean.

On motion of Mr. Melerine, seconded by Mr. Henderson, it was moved to
introduce the following ordinance:

BEING REPRESENTED BY FRED SIGUR AND WILLODEAN MANSELL BEIER TRUST, DANIEL A.
BEIER, SR., GLENN D. BEIER, SR., ERNEST BEIER, AND KATHERINE L. BEIER BEING
REPRESENTED BY WILLODEAN MANSELL BEIER FOR A CONDITIONAL USE IN AN “A-1
(RURAL)” ZONE TO “A-1/CU (CONDITIONAL USE)” TO COMPLY WITH ST. BERNARD
PARISH ZONING ORDINANCE, CHAPTER 22-5-6, SCHEDULE OF ZONING DISTRICT
REGULATIONS FOR TRUCK STOPS. MUNICIPAL ADDRESS NO. 909 BAYOU ROAD .

ST. BERNARD PARISH COUNCIL DOES HEREBY ORDAIN:

SECTION 1. That a Conditional Use for Docket 17-07, petition of
Taurus Properties, Inc. being represented by Fred Sigur and Willodean
Mansell Beier Trust, Daniel A. Beier, Sr., Glenn D. Beier, Sr., Ernest
Beier, and Katherine L. Beier being represented by Willodean Mansell Beier
for a Conditional Use in an “A-1 (Rural)” zone to “A-1/CU (Conditional Use)”
to comply with St. Bernard Parish Zoning Ordinance, Chapter 22-5-6 Schedule
of zoning district regulations for Truck Stops, be granted for the following
described property:

The Taurus property being described as THAT CERTAIN TRACT OR PARCEL OF LAND,
situated in the Parish of St. Bernard, State of Louisiana, in Section 16,
Township 13 South, Range 13 East, and forming a portion of Lot Nos. 15 and
17 of Sebastopol Plantation, said portion of property being designated as
PARCEL 2 in accordance with a plan of resubdivision by J.J. Krebs & Sons,
Inc., dated March 18, 1986, a copy of which is attached to Resolution
E-13-86 of the Police Jury for the Parish of St. Bernard, State of
Louisiana, recorded in COB 327, folio 213, on April 7, 1986, according to
said plan, the said PARCEL 2 measures as follows, to-wit:

Commence at the northwesterly intersection of the St. Bernard Highway and
Violet Poydras Highway and head North 00 degrees 13 minutes 00 seconds East
a distance of 240 feet to a point, the point of beginning. Thence from the
point of beginning, continue along the westerly boundary of the Violet
Poydras Highway, North 00 degrees 13 minutes 00 seconds East a distance of
2,531.06 feet to a point; thence continue along said westerly side of the
Violet Poydras Highway along a curve to the left having a radius of 1,282.39
feet, a distance of 718.50 feet to a point along the boundary line
separating Lot 15 from Lot 13, Sebastopol Plantation, thence turn and head
South 00 degrees 09 minutes 04 seconds West a distance of 3,204.10 feet to a
point; thence turn left and head South 87 degrees 16 minutes 09 seconds East
a distance of 192.59 feet to a point, the point of beginning.

AND, CERTAIN TRACTS OR PARCELS OF LAND owned by Willodean Mansell Beier
Trust, Daniel A. Beier, Sr., Glenn D. Beier, Sr., Ernest D. Beier, and
Katherine L. Beier, designated as:

A certain piece or portion of ground situated in the Parish of St. Bernard,
Louisiana, and designated as part of Farm Site Number 13 as shown on a map
of Sebastopol Plantation by J.W.T. Stephens, Civil Engineer, dated June 14,
1923, on file with the Clerk of Court for St. Bernard Parish, Louisiana, and
which portion of ground is described, according to survey made by H.E.
Sutch, Surveyor, dated August 26, 1949, as being part of Farm Site No. 13,
which is designated as Plot 13-B, in Section 16 (with possibly a small part
in Section 14) of T. 13 S., R. 13 E.

According to the said plan of H.E. Sutch, Surveyor, the said Plot 13-B
measures 116.02 feet front on Louisiana Highway No. 32 and Bayou Terre Aux
Boeufs, 116.09 feet in width in the rear by a depth on the Western side line
dividing Lot 13-B from Lot 13-A of 7,601.03 feet an by a depth on the
opposite or Eastern side line of 7,599.47 feet. The said Lot 13-B commences
at a distance of 268.02 feet east of the Section line between Sections 15
and 16, at the point where it meets Louisiana Highway No. 32; all as will
more fully appear by reference to the said blue print survey made by H.E.
Sutch, which is made a part hereof by reference as fully as though copied
herein in extenso.

And, the said property is described, according to the vendor’s Act of
Purchase, as follows:

THAT PORTION OF GROUND, situated in the Parish of St. Bernard, Louisiana,
and designated as part of Farm Site Number 13, containing 33.47 acres, all
as per subdivision map of Sebastopol Plantation by J.W.T. Stephens, C. &
M.E., dated New Orleans, Louisiana, June 14, 1923, on file with the Clerk of
Court for St. Bernard Parish, Louisiana, and which portion of ground is
situated in Section No. 11, Township 13 and 14 South, Range 13 East,
Southeastern Land District of Louisiana, about one and one-half (1 ½) miles
East of the Mississippi River. Said portion measures more or less 192.02
feet front on St. Bernard Highway , 191.15 feet in
width on the rear line by a depth of 7,602.03 dividing Lot 11 (Westside) and
7,599.47 dividing
Lot 15, having a uniform width of 191.84 feet between side lines.

LESS AND EXCEPT:

THAT PORTION OF GROUND, situated in the Parish of St. Bernard, State of
Louisiana, and being part of Farmsite Number 13 of Sebastopol Plantation
according to a Plan of Subdivision of Sebastopol Plantation made by J.W.T.
Stephens, C. & M. E., dated June 14, 1923, on file with the Clerk of Court
for St. Bernard Parish, Louisiana, and a copy of which is attached to an act
before Eldon S. Lasarus, Notary Public, dated June 28, 1923. The said
portion of ground previously sold, is a strip measuring 76 feet front by a
depth of 7,602.03 feet, more or less, taken from said Farm Site No. 13 on
the side nearest Farm Site 11 or the side nearest the Mississippi River, and
which said portion of ground is situated in Section 11, Township 13 and 14,
South, Range 13 East, Southeastern Land District of Louisiana, about one and
one-half miles East of the Mississippi River, and begins on the dividing
line between Farm Site 11 and Farm Site 13.

Improvements on Lot 13 B-1 bear the Municipal No. 909 Bayou Road .

SECTION 2. Effective Date. This ordinance shall become effective
immediately upon authorizing signature by the Parish President. In the
event of a presidential veto this ordinance shall become effective upon a
two-thirds favorable vote of the total membership of the Council pursuant to
Sections 2-11 and 2-13 of the St. Bernard Parish Home Rule Charter.

SECTION 3. Severability. If any section, clause, paragraph,
provision or portion of this ordinance shall be held invalid or
unconstitutional by any court of competent jurisdiction, such holding shall
not affect any other section, clause, paragraph, provision or portion of
this ordinance, the St. Bernard Parish Council hereby expresses and declares
that it would have adopted the remaining portion of this Ordinance with the
invalid portions omitted.



The above and foregoing having been submitted to a vote, the
vote thereupon resulted as follows:

YEAS: Madary, Hoffmeister, Henderson, Taffaro and
Melerine.

NAYS: Dean.

ABSENT: None.

The Chairman, Mr. Di Fatta, cast his vote as YEA.

And the motion was declared adopted on the 20th day of November,
2007.
