[StBernard] Obama Plans to Put a Toll on I-10

Currently, federal law prohibits any kind of toll or fee on a federal
highway - not that something like the law has ever stopped Obama before.
But this time, should he impose a toll on a federal road or highway, then
any citizen of the United States could file suit in federal court requesting
an injunction to throw it out since such a toll would be in violation of
federal law.

If you recall some years when discussion began about charging an entrance
fee to the national parks. It required Congressional approval. The U.S.
Constitution does not grant the executive branch any power to levy taxes or
usage fees such as tolls.

The articles also says...." In addition to bicycles and tolls, the
administration plan goes further in diverting gasoline tax revenue collected
from motorists for use on mass transit projects." Once again, that would
require an Act of Congress since the current law specifically dedicates
where the gasoline tax revenue is to be spent. To divert it elsewhere would
need legislation. Otherwise, any citizen could file a suit in federal court
to stop it.
